Purpose

This Best Practice Guide provides a structured approach for identifying, assessing, documenting and approving variations during residential construction projects.

Its objective is to promote greater transparency, clearer decision-making and more reliable project records throughout the construction process.

The Guide is intended to support homeowners, project managers and industry professionals in applying consistent practices that reduce unnecessary disputes and improve project governance.

This Guide represents recommended best practice and should be applied with appropriate professional judgement.

Guiding Principles

Principle 1
Every variation should be clearly defined.

A variation that lacks a clear written description of the change in scope, materials or specifications creates ambiguity that may lead to disagreements later in the project.

Principle 2
Every variation should be priced before work commences whenever reasonably practicable.

Agreeing on cost and programme implications before commencing work allows both parties to make informed decisions and avoids disputes about pricing after the fact.

Principle 3
Every variation should be supported by written records.

Verbal agreements, while common on building sites, are difficult to verify and enforce. Written records protect both the homeowner and the builder.

Principle 4
Owners should understand both the immediate and cumulative impact of variations.

Individual variations may appear modest, but their combined effect on budget and programme can be substantial. Tracking cumulative exposure is essential to maintaining project control.

Principle 5
Variation decisions should remain traceable.

A clear record of who requested, assessed, approved and implemented each variation provides an audit trail that supports accountability and dispute resolution.

Best Practice Process

Identify the variation

Confirm whether the proposed change falls outside the original contract scope. Record the source of the variation and the reason for the change.

Review contractual entitlement

Determine whether the variation is already addressed within the contract, whether it constitutes an additional item, and who bears the cost under the contract terms.

Assess commercial impact

Obtain a detailed quotation from the builder. Review the cost breakdown, confirm the programme impact and assess the cumulative budget exposure.

Obtain supporting documentation

Collect all relevant documentation including revised drawings, specifications, supplier quotations and any correspondence supporting the variation.

Owner review

Present the variation to the owner with a clear summary of the scope, cost, programme impact and any alternatives. Allow sufficient time for considered decision-making.

Document approval

Record the owner's decision in writing. If the variation is approved, confirm the agreed scope, price and any conditions. If declined, record the reasons.

Archive project records

File all variation documentation in the project record. Ensure the variation register is updated and the cumulative cost exposure is recalculated.

Common Project Risks

Risk

Work commences before approval. The builder proceeds with additional work before the owner has formally approved the variation, creating a fait accompli that limits negotiating position.

Scope is insufficiently defined. Vague descriptions of the variation scope lead to misunderstandings about what is included and what is excluded.

Variation pricing lacks transparency. Lump sum pricing without a cost breakdown makes it difficult for the owner to assess whether the price is reasonable.

Small variations accumulate into significant cost. Individual variations that appear modest can collectively represent a material budget overrun if not tracked cumulatively.

Approvals rely solely on verbal discussions. Decisions made verbally on site are difficult to verify later, particularly in the event of a dispute.

Supporting records cannot be located. Poor filing practices mean that variation documentation cannot be retrieved when needed for dispute resolution or final account reconciliation.

Recommended Practices

Define scope

Ensure every variation includes a written description of what is being changed, added or removed from the original contract scope.

Avoid verbal approvals

All variation decisions should be confirmed in writing, even if initially discussed verbally on site.

Maintain project records

Establish a variation register at the start of the project and update it each time a variation is raised, approved or declined.

Understand cumulative exposure

Track the running total of approved and pending variations against the original contract sum to maintain budget visibility.

Retain supporting correspondence

Save all emails, messages and meeting notes related to each variation. These records may be important in the event of a dispute.

Review contractual implications

Before approving a variation, consider how it interacts with existing contract terms, including extensions of time and liquidated damages.

Document decisions promptly

Record variation decisions as soon as they are made. Delays in documentation increase the risk of inaccurate records.

Preserve project records

Retain all variation documentation for a minimum period consistent with statutory limitation periods and contractual requirements.
