Guiding Principles
A building contract is a legally binding document that governs the entire project. Signing a contract without reading and understanding its key terms exposes the homeowner to obligations and risks they may not have anticipated.
Ambiguity in the scope of work is a leading source of disputes. The contract should clearly describe what is included, what is excluded, and the standard of work expected.
Progress payment schedules, deposit amounts, retention provisions and the circumstances under which payments are triggered should all be clear to the homeowner before execution.
Contracts allocate risk between the homeowner and the builder. The homeowner should understand where the risk sits for delays, cost overruns, defects and unforeseen conditions.
A homeowner's interests are best protected when the contract has been reviewed by an independent legal practitioner who is not associated with the builder or the builder's referral network.

Best Practice Process
Request the complete contract including all schedules, annexures, specifications and drawings. Do not review a contract that is missing attachments.
Determine whether the contract is a standard industry form (e.g. HIA, Master Builders) or a builder's proprietary contract. Standard forms generally offer more balanced terms.
Verify that the scope of work, materials, finishes and allowances match the owner's understanding and any pre-contract representations made by the builder.
Examine the progress payment schedule, deposit requirements, and the mechanism for claiming and certifying payments. Confirm alignment with statutory requirements.
Review clauses relating to variations, delays, extensions of time, liquidated damages, defects liability, dispute resolution and termination.
Engage an independent legal practitioner experienced in residential construction to review the contract and advise on any terms that require amendment or clarification.
Raise any concerns with the builder before signing. Document all agreed amendments in writing. Retain a signed copy of the complete contract for the project record.

Common Contract Risks
Contract is signed without independent legal review. The homeowner accepts terms they do not fully understand, limiting their ability to manage the project effectively.
Specifications contain insufficient detail. Vague specifications such as "builder's selection" or "standard inclusions" leave quality and material decisions entirely to the builder.
Allowances are set unrealistically low. Artificially low allowances reduce the apparent contract price but result in significant cost increases during construction.
Payment schedule is front-loaded. A disproportionate share of the contract sum is payable early in the project, reducing the homeowner's leverage if issues arise later.
Extension of time clauses are overly broad. Clauses that grant the builder extensions for a wide range of circumstances reduce the practical enforceability of the completion date.
Dispute resolution favours the builder. Non-standard dispute resolution clauses may limit the homeowner's access to statutory protections or independent adjudication.

Recommended Practices
Do not rely on verbal summaries. Read every clause, schedule and annexure before signing.
Cross-reference the contract scope with all pre-contract quotations, tender documents and representations to confirm consistency.
Request specific product names, model numbers, dimensions and finishes for all significant items rather than accepting generic descriptions.
Research the realistic cost of allowance items independently. Ensure allowances reflect actual market pricing, not artificially low estimates.
Confirm how progress payments are calculated, what triggers a claim, and what rights the homeowner has to withhold payment for incomplete or defective work.
Engage a lawyer who specialises in residential construction and is not affiliated with the builder. The cost of legal review is modest relative to the contract value.
Any agreed changes to the contract should be recorded in writing as formal amendments, signed by both parties, before execution.
Keep a complete copy of the signed contract and all attachments in a secure location for the duration of the project and beyond.
